ARTICLE 1 USE OF THE WEBSITE AND ONLINE STORE

By using this website, you confirm that you are at least 18 years old or are acting with the consent of a legal representative.

You may only use our website, products and services in accordance with applicable laws and regulations. You may not use our products, services or website for unlawful, fraudulent or unauthorised purposes.

Violation of these terms may result in the suspension or termination of your access to the website or our services.

ARTICLE 2 GENERAL PROVISIONS

Bulkx Mobility B.V. reserves the right to refuse, restrict or terminate services, orders or access to the website where there are reasonable grounds to do so.

All website content, including texts, images, product information, logos and designs, remains the property of Bulkx Mobility B.V. or its licensors. This content may not be copied, distributed or used commercially without prior written permission.

The titles and headings in these terms are provided for convenience only and do not affect the interpretation of the provisions.

ARTICLE 3 INFORMATION ON THE WEBSITE

We strive to keep all information on the website as complete and up to date as possible. Nevertheless, errors, omissions or outdated information may occur.

No rights may be derived from information provided on the website. Bulkx Mobility B.V. reserves the right to modify or remove information at any time.

ARTICLE 4 PRICES

All prices displayed are in euros and include VAT unless expressly stated otherwise.

Bulkx Mobility B.V. reserves the right to change prices at any time. Price changes will not affect orders that have already been accepted.

Obvious pricing errors or mistakes are not binding on Bulkx Mobility B.V.

ARTICLE 5 PRODUCTS AND AVAILABILITY

We make every effort to display products and images as accurately as possible. However, variations in colour, design or specifications may occur.

All products are offered subject to availability.

Bulkx Mobility B.V. reserves the right to remove products from its range, modify specifications or cancel orders if a product proves to be unavailable.

ARTICLE 6 ORDERS

An agreement is concluded once Bulkx Mobility B.V. has confirmed an order.

Bulkx Mobility B.V. reserves the right to refuse or cancel orders in the event of incorrect information, fraud, misuse or other legitimate reasons.

The customer is responsible for providing accurate and complete information.

ARTICLE 7 PAYMENT

Payment must be made using the payment methods offered on the website.

An order will only be processed once payment has been successfully received, unless otherwise agreed in writing.

ARTICLE 8 DELIVERY

Bulkx Mobility B.V. aims to deliver orders within the stated delivery times. Any delivery times provided are estimates and do not constitute strict deadlines.

A delay in delivery does not entitle the customer to compensation or termination of the agreement unless otherwise required by law.

The risk of loss of or damage to products passes to the customer once the products have been delivered.

ARTICLE 9 RIGHT OF WITHDRAWAL FOR CONSUMERS

If the customer is a consumer, they have the right to withdraw from an online purchase within 14 days of receipt without giving any reason, unless a statutory exception applies.

The consumer must return the product unused, undamaged and, where reasonably possible, in its original packaging.

Following a valid withdrawal, the purchase price, including standard delivery costs, will be refunded within 14 days, provided that the product has been received or proof of return shipment has been provided.

ARTICLE 10 WARRANTY

Consumers are entitled to the statutory warranty provided for under the Dutch Civil Code.

If a product does not meet what the consumer may reasonably expect, Bulkx Mobility B.V. will repair or replace the product or provide an appropriate solution in accordance with its statutory obligations.

ARTICLE 10A WARRANTY AND USE OF E-BIKES

10A.1 Statutory Warranty

All products supplied by Bulkx Mobility B.V. are covered by the statutory warranty. This means that a product must meet what the customer may reasonably expect from it, taking into account the nature of the product, the product information and the conditions of use.

10A.2 Manufacturer's Warranty

If an additional manufacturer's warranty applies to a product, the warranty conditions of the relevant manufacturer will apply. A manufacturer's warranty does not affect the consumer's statutory rights.

10A.3 Batteries

Batteries are subject to natural wear and capacity loss as a result of use, age, temperature, charging behaviour and storage conditions.

Normal reduction in battery capacity is not considered a defect and is not covered by warranty unless otherwise determined by the manufacturer or applicable law.

The customer must use, charge, store and maintain the battery in accordance with the instructions of Bulkx Mobility B.V. and/or the manufacturer.

10A.4 Wear Parts

Parts that are subject to normal wear and tear are not covered by warranty insofar as the wear is the result of normal use.

Wear parts include, but are not limited to:

Tyres
Inner tubes
Brake pads
Brake discs
Chains
Sprockets
Bearings
Grips
Pedals
Lights
Paint damage resulting from normal use

10A.5 Exclusion of Warranty

The warranty may be wholly or partially excluded if:

a. the product has been used incorrectly, carelessly or improperly;

b. maintenance has not been carried out in accordance with the manufacturer's instructions;

c. repairs or modifications have been carried out by unauthorised third parties;

d. damage has been caused by an accident, fall, water damage, fire, theft, vandalism or external influences;

e. non-original parts have been installed and have caused damage;

f. the product is used for rental, competitions, commercial use or other purposes for which the product was not designed.

10A.6 Maintenance Obligation

The customer is responsible for ensuring that the bicycle is maintained in a timely manner and in accordance with the manufacturer's instructions.

If a defect or damage has been caused or contributed to by failure to carry out necessary maintenance, a warranty claim may be refused.

10A.7 Assessment of Warranty Claims

Bulkx Mobility B.V. reserves the right to inspect a product before approving a warranty claim.

If, following inspection, it is determined that the complaint is not covered by warranty, inspection costs, transport costs and any repair costs may be charged to the customer, provided that the customer has been informed of these costs in advance.

10A.8 Repair or Replacement

If a warranty claim is accepted, Bulkx Mobility B.V. will determine whether the product will be repaired, replaced or credited, insofar as permitted by law.

ARTICLE 11 RETENTION OF TITLE

All delivered products remain the property of Bulkx Mobility B.V. until the full purchase price and any additional costs have been paid.

ARTICLE 12 THIRD-PARTY SERVICES AND LINKS

The website may contain links to third-party websites or services.

Bulkx Mobility B.V. is not responsible for the content, operation, availability or privacy policies of such external parties.

ARTICLE 13 REVIEWS, FEEDBACK AND SUBMITTED CONTENT

By providing reviews, comments, photos, videos or other content to Bulkx Mobility B.V., you grant us a non-exclusive right to use this content for commercial and promotional purposes.

You warrant that the content you provide does not infringe the rights of any third party.

ARTICLE 14 PRIVACY

Personal data is processed in accordance with the Privacy Policy of Bulkx Mobility B.V. and applicable privacy legislation, including the General Data Protection Regulation (GDPR).

ARTICLE 15 PROHIBITED USE

You may not use the website for:

Unlawful purposes
Fraud or deception
Distribution of malware
Infringement of intellectual property rights
Collection of personal data without consent
Interference with the security or operation of the website

In the event of a violation, access to the website may be terminated immediately.

ARTICLE 16 LIABILITY

Bulkx Mobility B.V. is only liable for direct damage resulting directly from an attributable failure to perform its obligations or from an unlawful act.

Any liability for indirect damage, consequential damage, loss of profit, loss of revenue, loss of anticipated savings or loss of data is excluded insofar as permitted by law.

Nothing in these terms limits liability for damage caused by intent, deliberate recklessness or any liability that cannot legally be excluded.

ARTICLE 17 INDEMNIFICATION

The customer indemnifies Bulkx Mobility B.V. against claims by third parties arising from the customer's unlawful use of the website, products or services.

ARTICLE 18 SEVERABILITY

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

ARTICLE 19 CHANGES TO THE TERMS AND CONDITIONS

Bulkx Mobility B.V. reserves the right to amend these General Terms and Conditions.

Changes will apply to new orders from the date they are published on the website.

ARTICLE 20 CANCELLATION OF AGREEMENTS

Purchases made in a physical store, showroom or other retail premises of Bulkx Mobility B.V. are not subject to a statutory right of withdrawal.

Cancellation of such agreements is only possible if Bulkx Mobility B.V. agrees to the cancellation in writing.

Any costs arising from an accepted cancellation may be charged to the customer.

ARTICLE 21 APPLICABLE LAW AND DISPUTES

All agreements, services and legal relationships with Bulkx Mobility B.V. are governed exclusively by Dutch law.

Disputes will be submitted to the competent court in the district in which Bulkx Mobility B.V. is established, unless mandatory legal provisions require otherwise.
